Security Deposit for Rent in Mumbai: How Much Is Normal, the Rules and Refunds (2026)
How much security deposit is normal when renting in Mumbai? Usually about 3 to 6 months' rent, and Maharashtra law sets no cap. See 2026 rupee examples by area, what the Rent Control Act and Model Tenancy Act say, and how to get your deposit back.

The security deposit is often the biggest shock when you rent a flat in Mumbai. Rent is paid monthly, but the deposit is one large sum you hand over before you get the keys, and in Mumbai it can easily run into lakhs. Here is how much landlords usually ask for, what Maharashtra law actually says, and how to get your money back.
Quick answer: in Mumbai, landlords commonly ask for a security deposit of about 3 to 6 months' rent, sometimes less in cheaper suburbs and more for premium or furnished flats. Maharashtra law does not cap the deposit, so the amount is whatever you and the landlord agree in writing. The two-months' rent cap you may have read about comes from the central Model Tenancy Act, which Maharashtra has not adopted. The deposit is refundable when you leave, minus genuine dues such as unpaid rent, bills or damage.
How much security deposit for rent is normal in Mumbai?
There is no official survey of deposits, but brokers and property portals typically quote 2 to 6 months' rent in big metros, and 3 to 6 months is a common ask in Mumbai. Some landlords in prime areas still ask for more. In practice, the deposit is negotiated flat by flat.
To see what that means in rupees, here is the deposit you could expect at 3 to 6 months' rent, using ANAROCK's average quoted rents for a 700 sq ft 2BHK in Q1 2026:
Area | 2BHK rent per month (ANAROCK, Q1 2026) | Deposit at 3–6 months' rent |
Worli | ₹86,000–1,38,000 | about ₹2.6 lakh–8.3 lakh |
Andheri West | ₹50,000–83,000 | about ₹1.5 lakh–5 lakh |
Chembur | ₹50,000–86,000 | about ₹1.5 lakh–5.2 lakh |
Mulund | ₹42,000–65,000 | about ₹1.3 lakh–3.9 lakh |
Kolshet Road, Thane | ₹28,000–40,000 | about ₹84,000–2.4 lakh |
Panvel, Navi Mumbai | ₹19,000–29,000 | about ₹57,000–1.7 lakh |
Dombivli | ₹15,000–23,000 | about ₹45,000–1.4 lakh |

What decides the deposit amount?
Location
Prime areas such as South Mumbai, Worli, Bandra and Andheri West have high rents, so even the same number of months means a much bigger deposit. Suburbs and satellite towns such as Thane, Navi Mumbai, Mira Road and Dombivli usually mean smaller amounts.
Monthly rent
The deposit is almost always quoted as a multiple of rent. At ₹30,000 a month rent, a 2-month deposit is ₹60,000 and a 6-month deposit is ₹1.8 lakh.
Furnishing and size
Fully furnished flats, with appliances, furniture and fittings, often carry a higher deposit because there is more that can be damaged.
Demand and your profile
When many tenants want the same flat, landlords can hold out for a higher deposit. Where there are plenty of vacant flats, you have more room to negotiate. Some landlords also ask for more from tenants they see as higher risk, for example a short work contract or no local references.
What does the law say about security deposits in Mumbai?
No legal cap under the Maharashtra Rent Control Act, 1999
Renting in Mumbai is governed by the Maharashtra Rent Control Act, 1999. Section 56 of the Act allows landlords to receive a deposit or other sum when they grant a lease, and the Act does not set a maximum. That is why deposits in Mumbai are a matter of agreement, not a fixed percentage.
The Model Tenancy Act's 2-month cap does not apply in Maharashtra
The Model Tenancy Act, 2021, approved by the Union Cabinet, caps residential deposits at two months' rent. But it is a model law: it only takes effect in a state that passes its own version. A few states, such as Uttar Pradesh and Andhra Pradesh, have passed laws based on it. In 2022 Maharashtra's housing department reportedly told the Centre it did not need the model law because its own Rent Control Act already covers rentals, and we have found no Maharashtra law adopting the cap as of November 2026. So the viral "new rent rules" posts about a two-month cap do not bind Mumbai landlords today. If that changes, it will be through a Maharashtra law or notification.
Your agreement must be written and registered
Section 55 of the Act says every leave and licence or rent agreement must be in writing and registered. Getting it registered is the landlord's responsibility, and a landlord who does not can face a fine of up to ₹5,000, imprisonment of up to three months, or both. If there is no registered agreement, the tenant's version of the terms is presumed correct unless proved otherwise. That is a strong reason to insist that the deposit amount and refund terms are written into a registered agreement.
Leave and licence: the usual Mumbai format
Most Mumbai flats are rented on an 11-month leave and licence agreement. Under Section 24 of the Act, a licensee must hand back the flat when the licence ends; one who stays on can be liable for double the licence fee as damages.
Stamp duty and registration cost
For leave and licence agreements, stamp duty is 0.25% of the total rent for the term plus a notional 10% yearly interest on the refundable deposit. The registration fee is ₹1,000 in municipal areas and ₹500 in rural areas. A larger deposit therefore slightly raises the stamp duty. Agreements can be registered online through the IGR Maharashtra leave and licence service, which also has a stamp duty calculator.
How to get your deposit back
Write the refund terms into the agreement. State the amount, when it will be returned (for example, on the day you hand over the keys) and what can be deducted.
Pay by bank transfer and keep a receipt. Avoid cash. The agreement should acknowledge the deposit received.
Record the flat's condition on move-in. Take dated photos and videos and list furniture and appliances. Share them with the landlord.
Clear your dues before leaving. Pay the last rent, electricity, gas and society maintenance, and keep the receipts.
Do a joint inspection on move-out. Normal wear and tear, like faded paint, is generally not a fair deduction; actual damage can be.
If the landlord refuses to refund, send a written request, then a legal notice. If that fails, take legal advice about approaching the appropriate court or authority with your registered agreement and payment proof.

Tips to reduce the deposit you pay
Compare listings in the same building or locality to know what is normal before you negotiate.
Negotiate months, not just rent. A landlord may accept 3 months instead of 6 if you agree to a longer lock-in or pay rent by standing instruction.
Offer documents upfront: employment letter, ID and references can make a landlord more comfortable with a lower deposit.
Consider zero-deposit options carefully. Services like CirclePe remove the need to pay a security deposit upfront by paying the landlord in advance and collecting rent from you monthly, for a fee. Compare the total cost with the deposit you would otherwise lock up, and read the terms before you sign.
Verdict
In Mumbai, expect to pay a security deposit of roughly 3 to 6 months' rent, and know that there is no legal cap in Maharashtra, so everything depends on negotiation and on what is written in your registered agreement. Treat the deposit as your money held in trust: get it in writing, pay through the bank, document the flat's condition, and you will be in a strong position to get it back in full.
